Welcome to Temansihat. These Terms of Use ("Terms") govern your access to and use of the Temansihat mobile application and website (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility and Age Restriction

You must be at least 18 years of age to use Temansihat. By using this Service, you represent and warrant that you are 18 years or older. If you are under the age of 18, you are strictly prohibited from accessing the Service.

2. Medical Disclaimer (Not Medical Advice)

Temansihat is an AI-powered assistant, not a medical professional.

  • No Professional Advice: The content, responses, and companionship provided by Temansihat are for informational and entertainment purposes only.
  • Not a Substitute: This Service is not a substitute for professional medical advice, diagnosis, treatment, or clinical prescriptions.
  • Emergency Situations: DO NOT USE THIS APP IN AN EMERGENCY. If you are experiencing a medical emergency, contact your local emergency services (e.g., 999 in Malaysia) or go to the nearest hospital immediately.
  • Consult Your Doctor: Always seek the advice of your physician or other qualified health providers with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or heard on Temansihat.

3. User Conduct and Prohibited Use

You agree to use Temansihat for lawful purposes only. You are strictly prohibited from:

  • Using the Service for any pornographic, obscene, or sexually explicit purposes.
  • Engaging in abuse, bullying, harassment, stalking, or threatening behavior toward others or via the platform's interfaces.
  • Attempting to reverse engineer, decompile, or disrupt the Service.
  • Generating content that promotes illegal activities, self-harm, or violence.

4. No Warranty ("As-Is")

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Temansihat provides no warranties, express or implied, regarding the accuracy, reliability, or availability of the Service. We do not guarantee that the AI's responses will be error-free or that the Service will meet your specific requirements.

5. Limitation of Liability

To the fullest extent permitted by applicable law, the management, owners, and developers of Temansihat shall not be held responsible or liable for any direct, indirect, incidental, or consequential damages, including but not limited to:

  • Personal injury or death resulting from the use or misuse of advice/information provided by the platform.
  • Loss of data or profits.
  • Emotional distress or mental health issues arising from interaction with the AI.

You use the Service at your own risk.

6. Suspension and Termination

Management reserves the right to suspend, bar, or terminate your access to the Service at our sole discretion, without notice, for any conduct that we believe violates these Terms or is harmful to other users, us, or third parties (e.g., misuse, harassment, or illegal activity).

7. Intellectual Property

All content, branding, logos, and software code associated with Temansihat are the exclusive property of Temansihat management. You are granted a limited, non-transferable license to use the app for personal use only.

8. Changes to Terms

Management reserves the right to change, modify, or update these Terms at any time without prior notice. Any changes will be effective immediately upon posting to the app or website. Your continued use of the Service following these changes constitutes your acceptance of the new Terms.

9. Indemnification

You agree to indemnify and hold harmless Temansihat and its affiliates from any claims, losses, or damages (including legal fees) resulting from your violation of these Terms or your use of the Service.

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.

Syarat-Syarat Penggunaan

Selamat datang ke Temansihat. Syarat-Syarat Penggunaan ("Syarat") ini mengawal akses dan penggunaan aplikasi mudah alih serta laman web Temansihat ("Perkhidmatan"). Dengan mengakses atau menggunakan Perkhidmatan ini, anda bersetuju untuk terikat dengan Syarat ini.

1. Kelayakan dan Had Umur

Anda mestilah sekurang-kurangnya berumur 18 tahun untuk menggunakan Temansihat. Dengan menggunakan Perkhidmatan ini, anda mengesahkan bahawa anda berumur 18 tahun ke atas. Jika anda di bawah umur 18 tahun, anda dilarang sama sekali daripada mengakses Perkhidmatan ini.

2. Penafian Perubatan (Bukan Nasihat Perubatan)

Temansihat adalah pembantu kecerdasan buatan (AI), bukan profesional perubatan.

  • Bukan Nasihat Profesional: Kandungan dan maklum balas yang diberikan oleh Temansihat adalah untuk tujuan maklumat dan persahabatan sahaja.
  • Bukan Pengganti: Perkhidmatan ini bukan pengganti nasihat perubatan profesional, diagnosis, rawatan, atau preskripsi klinikal.
  • Situasi Kecemasan: JANGAN GUNAKAN APLIKASI INI DALAM KEADAAN KECEMASAN. Jika anda mengalami kecemasan perubatan, sila hubungi talian kecemasan tempatan (contohnya: 999 di Malaysia) atau pergi ke hospital terdekat dengan segera.
  • Rujuk Doktor Anda: Sentiasa dapatkan nasihat doktor atau penyedia kesihatan bertauliah bagi sebarang soalan mengenai keadaan perubatan. Jangan sesekali mengabaikan nasihat perubatan profesional kerana sesuatu yang anda baca atau dengar di Temansihat.

3. Tingkah Laku Pengguna dan Larangan

Anda bersetuju untuk menggunakan Temansihat untuk tujuan yang sah sahaja. Anda dilarang sama sekali daripada:

  • Menggunakan Perkhidmatan untuk tujuan lucah, pornografi, atau seksual.
  • Melakukan penderaan, buli, gangguan (harassment), atau ancaman terhadap orang lain atau melalui antara muka platform.
  • Cuba melakukan kejuruteraan terbalik (reverse engineer) atau mengganggu operasi Perkhidmatan.

4. Tiada Jaminan ("Sedia Ada")

Perkhidmatan ini disediakan atas dasar "SEDIA ADA" dan "SEPERTI YANG TERSEDIA". Temansihat tidak memberikan sebarang jaminan, secara nyata atau tersirat, mengenai ketepatan, kebolehpercayaan, atau ketersediaan Perkhidmatan. Kami tidak menjamin bahawa maklum balas AI adalah bebas daripada ralat.

5. Had Liabiliti

Pihak pengurusan, pemilik, dan pembangun Temansihat tidak akan bertanggungjawab atas sebarang kerugian atau kerosakan, termasuk tetapi tidak terhad kepada:

  • Kecederaan diri atau kematian yang disebabkan oleh penggunaan atau salah guna nasihat/maklumat yang diberikan oleh platform ini.

Penggunaan Perkhidmatan ini adalah atas risiko anda sendiri.

6. Penggantungan dan Penamatan

Pihak pengurusan berhak untuk menggantung atau menyekat akses anda ke Perkhidmatan mengikut budi bicara kami, tanpa notis awal, bagi sebarang tingkah laku yang melanggar Syarat ini atau menyalahgunakan platform.

7. Perubahan Syarat

Pihak pengurusan berhak untuk mengubah atau mengemas kini Syarat ini pada bila-bila masa tanpa notis awal. Penggunaan berterusan anda selepas perubahan tersebut dianggap sebagai penerimaan anda terhadap Syarat yang baharu.
